At a Circuit Court Commenced and held in the Town of Osceola in St.
Clair County in the state of Missouri on Monday the 1st day of
August A.D. 1842

Ordered that Court adjourn untill Tomorrow 9 of the Clock
Tuesday morning 9 of the Clock, Court met pursuant to Adjournment –
present as on Yesterday

Now at this Day comes the parties by their attornies and upon their
motion This Cause is Ordered to be Dismissed Each party paying One
half of the Causts in this Cause Expended.

Petition to foreclose mortgage
Now at this day Comes the parties by their attornies and the said
defendant Says he Cannot deny but that he owed and Stands Justly
indebted to the said Complainant in the sum of One hundred and
nineteen Dollars for his debt and the further sum of one Dollar for
his Damages by way of interest, And the said Defendant Says he
Cannot deny but that he Executed the said mortgage in the
Complainants petition mentioned – Therefore it is considered by the
Court here that the said Complainant recover of the said defendant
he Sum of One Hundred and nineteen Dollars for his Debt and the
further sum of One Dollar for his Damages Together with his Costs
and charges in this behalf laid out and Expended And that he have
thereof his writ

Of Execution, and it is ordered and decreed that the said Execution
be levied and made of the property in said petition mentioned And if
the said property shall not be sufficient to satisfy the debt
Damages and Costs aforesaid then the residue to be levied of other
goods and Chattles lands and tenements of the said Defendant.

Bill for partition of Lands
Now at this Day Comes Philip Crow one of the Complainants in this
cause and one of the purchasers of a portion of the property in said
petition mentioned and Suggests a Mistake in the Sheriffs Deed to
Said Crow, and prays the court that the words “Block No. 7” on the
3rd page of said deed May be so altered as to read Block No. four,
and that the same alterations be made upon the records of said deed
in the office of the Clerk of the St. Clair Circuit Court Whereupon
the Court after hearing the motion and upon Sufficient Evidence
being offered to the Court here do order that the said Sheriff make
the amendments aforesaid, and that when so amended the Clerk of this
Court do make a Similar amendment upon the records of said deed,
Whereupon John Smarr Sheriff as aforesaid amends said deed according
to the prair aforesaid – Whereupon the said John Smarr as Sheriff as
aforesaid who is Known to be the person whose name is subscribed to
said deed Acknowledges the same to be his act and deed for the
purposes therein mentioned.
Ordered that Court Adjourn untill Tomorrow Morning 8 of the Clock.

Petition to foreclose mortgage
Now at this day comes the plaintiffs here into court and files their
petition And the defendant being personally present in Court Say he
Cannot deny but admits that he Stands Justly indebted and bound to
the said Complainants as in the Said Complainants petition is
mentioned Amounting to Two Thousand Seven Hundred and Eight Dollars
and Ninety four cents Therefore it is considered by the Court here
that the said Complainants recover of the said Defendant the sum of
Two Thousand Seven hundred and Eight Dollars and ninety four cents
for their debt So confessed by the Defendant as aforesaid Together
with his costs and charges in this behalf laid out and Expended –
And it is further ordered, adjudged and decreed by the Court here
that the following described lands mentioned in the plaintiffs
petition viz the North East

Quarter of Section No. Sixteen and South east quarter of No. Sixteen
in Township No. Thirty Eight in Range No. Twenty five west, also the
west half of the north west quarter of section No. fifteen in
Township No. Thirty Eight in range No. Twenty five west Also the
South East quarter of the North West quarter of section No. Twenty
One in Township No. Thirty Eight of range No. Twenty five west Also
fifty Acres from off the south end of the west half of the South
west quarter of section No. Twenty in Township No. Thirty Eight in
range No. Twenty five west lying and being in St. Clair County and
State of Missouri be levied on and Sold to Satisfy the Same – And it
is further ordered that if the Mortgage property be not Sufficient
to Satisfy the aforesaid debt that other goods And Chattles lands
and tenements be levied on to Satisfy the residue.

Now at this day comes the Complainants by their attorney and files
here in court their Petition and the defendant being present in
Court Says he Cannot deny but admits the owes and Stands Justly
indebted and bound to the said Complainants as they hereof Complain
of him amounting to One Thousand Eight hundred and Thirty four
Dollars and Ninety five cents for their debt And forty seven Dollars
and Thirty Seven Cents for their Damages. Therefore it is Considered
by the Court here that the Said Complainants recover of the said
Defendant the sum of One Thousand Eight Hundred and thirty four
Dollars and ninety five Cents for their debt and forty seven Dollars
and Thirty Seven Cents for their damages together with their Costs
and Charges in this behalf laid out and Expended and that they have
thereof their writ of Execution – And it is Ordered Adjudged And
decreed that the following real estate Viz – The North East
fractional quarter of Section No. Seventeen in Township No. Thirty
Eight of range No. Twenty five west Containing about Ninety Seven
Acres Also

the South East quarter of Section No. Seventeen in Township No.
Thirty Eight of range No. Twenty five west also the north half of
the North West quarter of section No. Twenty one in Township No.
Thirty Eight of range No. Twenty five west, also that portion of the
east half of the south west quarter of section No. Twenty in
Township No. Thirty Eight of range No. Twenty five west Containing
about fifty five Acres also the North half of the west half of the
north East quarter of section No. Twenty in Township No. Thirty
Eight of range No. Twenty five west be levied on by virtues of the
Execution in this Cause as the Mortgage property in said
Complainants petition mentioned to Satisfy the same And it is
further ordered that if the said Mortgaged property be not
sufficient to satisfy the debt damages and Costs aforesaid then the
residue to be levied of other goods and Chattles lands and Tenements
of the Defendant.

Now at this day this Cause Comes on for Consideration And the Court
having heard the argument of Counsel and being now fully advised –
doth order that so much of the order heretofore entered in this
Cause dismissing the Original Bill be resended and set aside, And
that so much of the order dissolving the injunction remain in full
force and effect It is further ordered by the Court that the
defendants have leave untill the next term of this Court to Answer
or demur to the original bill filed in this Cause or to move to
dismiss the same interest is allowed on debt and 4 pt. Cent
additional.
