Plaintiffs

Russel G. Cole and Emily Cole – Defendants
Petition for assignment of Dower and Partition and sale of Real
Estate
Now at this day comes the said comes the said Plaintiffs and files
in the office of the Clerk of the Circuit Court of St. Clair County
in the State of Missouri their petition verified by affidavit and it
appearing from said affidavits that Russel G. Cole and Emily Cole,
the said Defendants are not residents of the State of Missouri, It
is therefore ordered by the undersigned Clerk of said St. Clair
Circuit Court in vacation, that said defendants, be notified of the
commencement of this suit and that plaintiffs have filed their
petition the object and general nature of which, is to obtain from
said Court, a judgment and decree for the assignment of Dower to
Elizabeth Hinkle widow of William Hinkle deceased, and for the
partition and sale of the following described Real Estate, situated
in St. Clair County Missouri to wit; The S.W. frl qr of Section No.
6 in Township No. 38 of Range No. 24, containing 205 19/100 acres,
and the S.E. frl qr of Section No. 1, in Township No. 38 of Range
No. 25, containing 107 67/100 acres, and for a division of the
proceeds of said sale among the parties thereto, according to their
respective rights and interests; and that unless said defendants be
and appear, before said Court, at the next term thereof which will
commence, and be held on at the Court House, in the Town of Osceola
on Monday the 5th day of

May 1856, and on or before the third day of said Term, answer or
demur to said petition, the same will be taken for confessed
And it is further ordered, that a copy of this order be published in
the “South West Democrat” as the law requires.

Albert Sheldon and Eliza Sheldon, Albert G. Gardner, Sarah Gardner
and Eliza Gardner, by her guardian Sarah Gardner – Plaintiffs
against
William Gardner, and Thomas J. Gardner – Defendants
Civil Action for assignment of dower and partition of Real Estate &
Slaves
Now at this day comes the said plaintiffs by their Attorney and file
in the office of the Clerk of the Circuit Court of St. Clair County
in the State of Missouri, their petition verified by affidavit and
it appearing from said affidavit that William Gardner and Thomas J.
Gardner the said defendants are not residents of the State of
Missouri, It is therefore ordered by the undersigned Clerk of said
St. Clair Circuit Court, in vacation, that said defendants be
notified of the commencement of this suit, and that plaintiffs have
filed their petition, the object and general nature of which is to
obtain from said Court, a judgment and decree for the assignment of
Dower, to Sarah Gardner, widow of James Gardner deceased, and for
partition and sale of the following described Real Estate situated
in St. Clair County, Missouri towit; The North West qr of Section
No. 8 in Township No. 38 of Range No. 24 containing 160 acres, also
the East half of the North East qr of Section No. 7 in Township No.
38 of Range No. 24 containing 80 acres; and also the following named
slaves To wit; Luke, Jane, Vina, Mary, Palsey, Frances, Earmine and
Al; and for a division of the proceeds of said sale, among the
parties, entitled thereto according to their respective rights and
interests And that unless said defendants be and appear before said
Court at the next term thereof which will commence and be holden at
the Court House in the Town of Osceola on Monday the 5th day of May
1856 and on or before the third day of said Term answer or demur to
said petition, the same will be taken as confessed as And it is

“Democratic Lancet” as the law requires.

Replevin
Now at this day comes the said plaintiff by his attorney, and files
his declaration, the object and general nature of which, is to
recover from said defendant one Gray horse, charged to be unlawfully
detained by the defendant. And said declaration being verified by
affidavit of said plaintiff as the law requires.
It is therefore ordered by the undersigned Clerk of the Circuit
Court of St. Clair County Missouri, that the said defendant deliver
the property specified in said plaintiffs affidavit to wit; one gray
horse gelding to the Sheriff of St. Clair County Missouri, and that
if the same be not delivered to him, that he take the same from the
said defendant and deliver it to the said plaintiff.

Petition for Partition of Land
Now at this day comes the said plaintiff and dismisses this suit at
his costs. It is therefore ordered by the undersigned Clerk, that
this suit be dismissed and discontinued and that the said plaintiff
pay the costs that have accrued in this behalf.
