Replevin for a Negro man Slave
Now at this day comes the said plaintiff and files his declaration the general nature and object of which is to recover from the said Defendant one negro man slave named Squire alleged to be unlawfully detained by the said Defendant And said declaration being verified by the affidavit of Said Plaintiff as required by law It is therefore ordered by the undersigned clerk of the Circuit court of St. Clair county Missouri that the Said Defendant deliver the said property Specified in said plaintiffs affidavit to the Sheriff of St. Clair County Missouri that if the same be not delivered to him that he take the Same from Said Defendant and deliver it to said Plaintiff.

The court having failed to meet pursuant to adjournment And the Judge of this the St. Clair Circuit court having notified the Sheriff of St. Clair county Mo. That court would not be held at this time at this place according to last adjournment court was by proclamation of the Sheriff made at the courthouse was adjourned until court in course.

Now at this day comes the Said Plaintiff and files in the office of the clerk of the circuit court of St. Clair county in the State of Missouri his petition verified by affidavit And it appearing from said affidavit that Francis F. Gwatheney, John Hall, Fanny Hall, Humphrey B. Hereford, Robert Hereford, Lawrence L. Hereford, John E. Lewis, Elen E. Lewis, Harold Lewis and George Lewis who are defendants in said petition are not residents of the State of Missouri It is therefore ordered by the undersigned Clerk of said St. Clair circuit court in vacation that said non resident defendants be notified of the commencement of this suit and that said plaintiff has filed his said petition the object and general nature of which is to obtain from said court a Judgment and Decree for Partition and division of the following described real Estate Situated in St. Clair county Missouri To wit Lot No. one in Block No. Five And Lots No. Ten, Eleven, and Twelve in Block No. Six all in the Town of Osceola in Said county of St. Clair and for a sale thereof if partition in Kind cannot be made without great prejudice to the parties interested therein and for a division of the proceeds of said Sale among the parties thereto according to their respective rights and interests And that unless said nonresident defendants be and appear before said court at the next term thereof which will commence and be holden at the courthouse in the Town of Osceola on Monday the third day of November next and on or before the third day of said term answer or demur to Said petition the same will be taken as confessed as to them And It is further ordered that a copy of this order
