Now at this day Comes the parties by their attornies And the defendant by his attorney moves the Court for leave to file his Answer to the said complainants bill in Vacation 60 days before the next term of this Court – And to him leave is granted – And this cause is ordered to be continued untill the next term of this Court.

Ordered that court Adjourn untill tomorrow morning 8 Oclock.

Petition to foreclose Mortgage
It is ordered that the said William Moore, who is proven to be a nonresident of this state be notified that the said John F. Weidemeyer has filed a petition to foreclose the said Mortgage, the object And general nature of which said petition is to foreclose a certain mortgage therein named, dated the 25th day of November A.D. 1843 and

Executed by the Said William Moore to the said John F. Weidemeyer on the following described tract of land, mentioned in the said petition To wit the N.E. quarter of the S.E. quarter and the S.E. quarter of the N.E. quarter of Section No. 23 in Township No. 38 in range No. 25 West Containing 80 acres all of which land is lying in St. Clair county and State of Missouri and which said mortgage was given to Secure the said John F. Weidemeyer in the aggregate sum of thirty Dollars, for which he had exempted his notes as the Security of Said Wm. Moore and which said sum of thirty Dollars was to be paid by the 25th day of May A.D. 1844 & that unless the said Wm. Moore enter his appearance at the next term of this court to commence and beheld in the Town of Osceola in said county, on the second Monday after the fourth Monday in March 1846 Judgment by default will be awarded against him and the equity of redemption in said lands will be foreclosed and the same sold to satisfy said debt. It is further ordered that a copy of this order of publication be published in some newspaper published in this State for Eight weeks successively the last insertion of which to be four weeks before the next term of this court until which time this cause is continued.

Now at this day comes the Complainant by his attorney And files herein his petition for a Sequestation against the property of the said defendant, which petition being seen and heard by the Court, the Court doth take the Same under advisement untill the next term of this Court, untill which time this Cause is Ordered to be Continued.

Now at this day Come the parties by their attorneys and both parties being ready for trial the cause is Submitted to the Court – Whereupon the Court after hearing the allegations and proof thereon do order that the said Bill be dismissed and the Injunction dissolved And the Court doth further order and decree that the Said Defendant recover of the said Plaintiff the Sum of fifty One Dollars and Seventy three Cents for his debt as well as the further sum of ten Dollars and fifty Seven Cents for his damages as well as his costs and
