Now at this day comes the said plaintiff and says he will not
further prosecute this action and directs the cause be dismissed at
his costs whereupon said cause is by the order of clerk of the
circuit court of St. Clair County Missouri dismissed at the costs of
said plff this 1st day of November 1858.

Now at this day comes the said Plaintiffs by her

In Vacation
Attorney and files in the office of the clerk of the Circuit Court
of St. Clair County Missouri in vacation of said Court for petition
aggainst the above named defendants, and it appearing from the
affidavit filed with said petition that the said defendants Lucas W.
Gifford and John Gifford and William R. Madison, are non residents
of the State of Missouri. Thereof I James W. Beck clerk of the
Circuit Court of St. Clair County do make the following order To
Lucas W. Gifford, John Gifford and William R. Harden the above named
non resident defendants, you and each of you are hereby notified
that said plaintiff has filed his petition and commenced suit in the
circuit Court of St. Clair County the Issue and general nature of
which is to recover judgment against all the above named defendants
on a promissory note executed by you to said plaintiffs for the sum
of eight thousand Seven hundred and ten dollars and ½ cents dated
the 11th day of September 1857 due twelve months of date, with
interest at the rate of ten per cent accrued from date until paid
the interest payable annually on the 21st day of December and all
the interest not personally paid to become principal and bear
interest accordingly with the law therein one amount dated January
1st 1858 and the amount for $88.00 dated February 17th 1858 paid on
the interest on said note And that unless you and each of you appear
at St. Clair County Mo at the term next in the town of Osceola at
the next term thereof to be begun and held on the first Monday in
March and within such time during said term between same will be
taken as confessed by you said non residents defendants It is
further ordered that a copy of this order be published in the
Osceola Independent as the law directs.

Now at this day comes the said Plaintiffs by their attorney and
files in the office of the clerk of the Circuit Court of St. Clair
County Missouri in vacation of said Court their petition against the
above named defendants and it appearing from the affidavit filed
with Said petition that the said defendants, James Phillips, Isaac
Phillips, Joseph Kilsey, Ellen Kilsey, Edward Harper and Nancy
Harper, William Brannon and Jane Brannon are non residents of the
State of Missouri. Therefore I James W. Beck clerk of the Circuit
Court of St. Clair County Missouri do make the following order. To
James Phillips, Isaac Phillips, Joseph Wilsey and Ellen Wilsey,
Edward Harper and Nancy Harper, William Brannon and Jane Brannon,
the above named non residents. You and each of you are hereby
notified that said Plaintiffs have filed their petition and
commenced suit against you in this Circuit Court of said St. Clair
County by Suit and general nature of which is to claim in said Court
judgment and decree for Partition of the following described Real
Estate situated in the county and state of Missouri To wit Lot No. 1
and North half of lot No. 2 of SW qr of Section No. 19 in Township
No. Fifty Range No. 24 containing 120 acres among and between said
Plaintiffs and defendants according to their respective rights and
interests therein as heirs and distributors of the Estate of Daniel
Phillips Deceased and for a sale thereof if partition thereof cannot
be made in Kind without great prejudice to the owners and for
division of the proceeds of the sale among and belonging to the
parties and that each of you be and appear before the Judge of Said
St. Clair Circuit Court at the Courthouse in the Town of Osceola at
the next term thereof to be begun and held on Monday the seventh day
of March next and or before the fourth day of said term plead answer
or demur to said petition the same will be taken as confessed by you
said non resident defendants It is further ordered that a copy of
this order be published in the Osceola Independent as the law
directs.

Now at this day comes the said Plaintiff and says he will not
further pursue this action but dismisses the same at his costs. And
by his direction this cause is dismissed by the undersigned Clerk of
the Circuit Court of St. Clair County Missouri in vacation of said
Court, at the costs of said Plaintiff this 28th day of January 1859.

by the motion of said plaintiff this cause is dismissed by the

in vacation of Said Court at the costs of said Plaintiff this 5th
day of March 1859.
