In Vacation December 14th 1853

Elizabeth Bailey
Petition for Divorce
Now at this day comes the Said Plaintiff and files his Petition
verified by his affidavit And it appearing from the affidavit of
Said Plaintiff filed with Said Petition that the Said Defendant and
is a nonresident of this State It is therefore on application of
said Plaintiff by his attorney Ordered that Said Defendant be
notified by publication according to law of this order That the Said
Plaintiff has instituted in the St. Clair circuit court within and
for the county of St. Clair in the State of Missouri an action
against the Said Defendant the object and general nature of which is
to obtain a divorce from The bonds of Matrimony by him contracted
with the Said Defendant on the Ground of willful desertion And

In Vacation
that unless she be and appear at the next Term of the St. Clair
circuit court to be begun and held at the courthouse in the Town of
Osceola on the first Monday in May next and on or before the third
day thereof answer the Petition of the Plaintiff the same will be
taken as confessed.

Now at this day comes the Said Plaintiff by Wm. J. Mays his attorney
and dismisses this Suit and by agreement of the Parties William A.
McClain attorney for said Defendant being present it is ordered by
the undersigned clerk of the St. Clair circuit court that Each of
said Parties be taxed with one half of the costs in this cause And
on motion of Said Plaintiff by his attorney Leave is granted him to
withdraw the note Sued on.

In Vacation Feby 1854
Now at this day comes the Said Plaintiffs and files their petition
and it appearing from the affidavit filed with Said Petition that
William Potter, Elizabeth Potter, Thomas Potter, Ruth Potter, Anna
Potter, Rebecca Potter, Mary Potter, Jane Potter, James P. Potter,
and James G. Anderson are non residents of the State of Missouri and
that the names and Residence of the heirs of John Anderson Deceased
are unknown to Plaintiffs. It is therefore ordered, by the
undersigned clerk of the circuit court of St. Clair county Mo. That
Said nonresidential and unknown defendants be notified of the
commencement of the suit the object and general nature of the Said
petition is to obtain partition of the East half of the South East
fractional quarter of Section No. 25 in Township No. 35 of Range No.
27 containing 72 80/100 acres Situated in the County of St. Clair in
the State of Missouri and if Partition cannot be made without great
prejudice for a Sale thereof and division of the proceeds among the
Parties according to their respective interests Petition States that
Said real Estate was the property of Nancy Anderson Deceased and
that the heirs of John Anderson deceased who was Son of the Said
Nancy Anderson Deceased are entitled to one undivided eleventh part
of Said real Estate Jointly and that the names and residence of Said
heirs are unknown to Plaintiffs And that unless they be and appear
at the next Term of the Said St. Clair circuit court to be begun and
held at the courthouse in the Town of Osceola on the first Monday in
May next and on or before the third day of Said Term answer Said
Petition the Same will be taken as confessed And it is further
ordered that a copy of this order be published in the Osceola
Independent a news paper published in the Town of Osceola in St.
Clair county Mo. for eight weeks Successively, the last insertion to
be at least four weeks before the first day of the said next Term of
said court.
