Now at this day Came the petitioners by their attorney Waldo P. Johnson before me Charles P. Bullock Clerk of the said Circuit Court, and in vacation of one and each and it appearing to the said clerk that the defendant Edmund Sams, Thomas Foster and Orry Foster, John Roberts and Rebecca Roberts, Anson B. Sams and Larkin Sams and Mitchell A. Sams, Mirada Felmot and ---- Felmot husband of said Marada and Caroline Motes and ---- Motes husband of said Caroline are now residents of the State of Missouri.
It is Therefore ordered by the said clerk in vacation that the said now resident defendants be notified that the said petitioners have this day filed their petition in said court, The object and general nature of which petition is to obtain partition and division of the following described lands belonging to the estate of Burdis Sams deceased The E ½ S.E. qr and S.W. qr of the S.E. qr of Lot No. 35 Township 37 of Range 25 containing 120 acres and the N.E. qr Sec. No. 2 Township No. 36 of Range No. 25 Containing 129 72/100 acres and the W. ½ S.W. qr sec. No. 36 Township No. 37 of Range 25 Containing 80 acres and the E ½ S.E. qr of Section No. 2 in Township No. 36 of Range No. 25 – Containing 50 acres and N.W. ½ N.W. qr of Section No. 1 Township No. 36 – of Range No. 25 containing 80 16/100 acres also two lots in the town of Osceola and Known upon the Plat of Said Town as lot No. 6 in Block No. 14 and Lot No. 10 in Block No. 35 said lands lying and being in the

County of St. Clair and State of Missouri, and unless said lands can be divided without prejudice to the parties that the same be sold, And it is further ordered that unless the said now resident defendants appear and answer the said petition on the first day of the next Term of the said Circuit court to be begun and held at the Court House in the town of Osceola in said County on Monday the 29th day of April or as soon Thereafter as a hearing can be had in said Term, The said petition will be taken as confessed against Them, And it is further ordered that a copy of this order be published in some newspaper in this State, published in same or near the County of St. Clair aforesaid for 8 week successively, The last insertion to be at least four weeks before the 1st day of said next Term of this Court.
