As a Special Term of the St. Clair circuit court begun and held in
the court House in Osceola in the County of St. Clair and State of
Missouri June 12th day.
Present: Hon. Burr H. Emerson Judge.

The Sheriff of St. Clair County returned here into court the list of
Names by him Summoned to the Special Term of the Court as follows to
wit:
Osceola Township – A.J. Pugh, Ray C. Allen, John Hauhan, G.B. Doak,
John Wheeler, Mayfield Hoskans, William Duley, Thomas A. Bealy, M.D.
Allinson, Daniel Hawkins & Henry Drury
Monegaw Township – G.D. Hart, Riley Lewellen, [can’t read], John R.
Lewellen, [can’t read], William Lewellen.
Washington Township – William S. Dempsey, R.E. Yost, Jonathan King,
[can’t read] S.H. Elkins, J. Ritchey, [can’t read].
Polk Township – G.W. Gray, George E. Hester, Jeremiah Ray, Richard
Lewis, John Short, Elisha Bridges.

Mayfield Hoskins.

Speedwell Township – James M. Dudley, Ephraim Nicholes & Levi M.
Croy.
Washington Township – John M. Dooley, John Whitaker & William S.

Seventeen Good and lawful men who were duly Sworn and empanelled as
a grand Inquest for the State of Missouri and for the body of the
County of St. Clair who after receiving their charge from the court
retired to consider of their presentments.
Ordered that Court adjourn till tomorrow morning 6:30 oclock

George W. Short, one of the Grand Jurors being withdrawn from the
Grand Jury by order of Capt. Cook, William Lewellen was Sworn in to
Supply the [can’t read].
Ordered that Court Adjourn till to Morrow Morning ten O,clock
Wednesday 15th day AD 1865.

Indictment for Murder.
Court being Called, it was ordered by the Court that the Sheriff of
St. Clair County Swear in a Jury for the trial of the above case,

Court met as at Friday morning June the 16th day AD 1865, and the
Sheriff of St. Clair County being [can’t read] issued by the Clerk
of St. Clair circuit Court Commissioning him Said Sheriff Summons
thirty Six, Lawful Men of his County as jurors in the County Court
of St. Clair County as a Special Term thereof to [can’t read] here
before Court wherein the State of Missouri is Plaintiff and Benjamin
F. Roberts, Defendant (returned into Court the following named
persons. Abram Cole. H.R. Cole. Wm. H. Scoby, Benjamin Elkins,
George E. Morland, W.W. Willard, George W. Hendricks, Andrew J.
Sims, Wiley B. Hatfield, Wm. George, Hedrick Smith, J.W. Copeland,
Daniel C. Roberts, O.B. Copeland, Robert Martin, John H. House,
Alfred Heard, Jonathan Gertz, Albert Sheldon, King C. Allen, John
White, Thomas E. Beal, Matt Allinson, Daniel Hendricks, Alfred
Reese, Wm. Gash, Isaac Pagers, S.H. Martin, Hezekiah Thompson,
Richard Smith, John Crenshaw, Jacob Allen, J. D. Roberts, Basil
Brown, James Haley, Isaac Waldo, thirty six men of St. Clair County
Mo. from whom were selected the following named persons to serve as
Jurors in the trial of the above mentioned cause towit Abraham Cole,
H.B. Cole, Wm. O. Mead, Robert Smith, G.W. Calvird, O.B. Copeland,
Hesekiah Thompson, Richard Lenox, John Lewelen, John Roberts, Paris
Brown & Daniel Mills Twelve men of St. Clair County who after

having been called and Sworn, proceeds to hear the evidence of in
Said Cause. The following named persons were then brought forward as
witnesses on the part of the State viz Zachariah Boatman, George
Estes & Levi H. Croy, and in the part of the defendant, Robert D.
Shields, Daniel Puckett, James Cole, William Barnes, Elias Disney &
John Hawkins, the above mentioned Jury after hearing and considering
the evidence in the above cause returned into court the following
verdict
“We the Jury find the Defendant not Guilty as charged in manner and
form in the Indictment.”
