At a Circuit Court Commenced and held at the Dwelling house of
William Gash in the County of St. Clair in the State of Missouri on
Monday the 29th day of March in the Year of Our Lord Eighteen
Hundred and Forty One.
Proven: Foster P. Wright, Circuit Judge.

John Smarr, Sheriff
The Sheriff of St. Clair County returned here into Court the Venire
facial for a Grand Jury, from which was sworn and impannelled the
following named persons, as a Grand Jury for the State of Missouri
for the body of the County of St. Clair To Wit:
Joseph W. Cox foreman, Burdett Sams, Thomas Pilser, William
Culbertson, Isaac Culbertson, Joel Redman, William E. Marlow,
Richard Stow, William Wright, Robert Anderson, David Collins,
Randolph Whitley, John Bird, Obediah Smith, John Gordon, John Long
and Robert Williams who having Received their charge retired to
Consider of their presentments – who returns here into Court a True
bill against Charles Beale and William Beale for Grand Larceny also
another true bill against Charles Beale and William Beale for Grand
Larceny, and having no further business before them were by the
Court discharged.

On Motion of the Circuit Attorney it is Ordered by the directed to
the sheriff of St. Clair County, returnable to the next term of this
Court, untill which time this Cause is Ordered to be Continued.

Now at this day comes the Circuit attorney prosecuting for the State
and upon his motion it is ordered by the Court that a Capias do apue
against the said Defendants directed to the Sheriff of St. Clair
County returnable to the next term of this Court untill, which time
this Cause is Ordered to be Continued.

And at this day comes John Smarr Sheriff of St. Clair County and
tenders to the Court here his official Bans given in vacation of the
Court, which is by the Court approved, and ordered to be recorded.

Appeal
Now at this day Comes the parties by their attornies and the
Defendant by his attorney moves the Court for a Continuance of this
Cause, which motion being fully heard and understood and for good
cause shown is ordered to be Continued untill the next term of this
Court at the Defendants Costs.

Now at this day Comes the parties in their now prepared persons and
the said Defendant Preposes a judgment in favour of the said
plaintiff for the sum of One Hundred and Sixty Six Dollars and Fifty
Cents for his debt also The sum of Three Dollars and Twenty five
cents for his Damages by way of interest at the rates of six per
Centum per Annum. Therefore it is Considered by the Court that the
said plaintiff recover of the said Defendant the Sum of One Hundred
and Sixty Six Dollars and fifty cents for his debt, and the sum of
three Dollars and twenty five Cents for his damages, Preposes as
aforesaid together with his Costs by Lessee on this behalf Expense
and that he have thereof Execution.

Recognizance to Keep the Peace
Now at this day Comes the Circuit Attorney on behalf of the State of
Missouri as well as the said defendant in his own proper person and
both parties bring ready for trial whereupon all and singular the
premises being seen and fully heard and understood by the Court the
Court doth consider that there is not sufficient Cause further to
recognize the Said defendant. Therefore it is ordered by the Court
that the said Defendant from this Said recognizance be discharged
and that he go thereof without day.

And upon his motion this cause is Ordered to be disrupted at the
plaintiff’s Costs – Whereupon the plaintiff by his attorney moves
the court for leave to withdraw the instrument due upon and to him
leave is granted.

Appeal
Now at this Day Comes the parties by their attornies, and the
defendant by his attorney files herein his motion to dismiss this
cause and reverse the judgment of the Justice, which motion bring
Assn. and fully heard & understood by the Court is by the Court
Sustained. Therefore it is Ordered by the Court that the Judgment of
the Justice be reversed and this Cause dismissed and that the said
Defendant recover of the said plaintiff his costs and charges on His
behalf laid out and Expended as well as the Court below as in this
Court, and that he hand thereof Execution.

Appeal
Now at this day Comes the plaintiff by his attorney and upon his
motion this Cause is Ordered to be dismissed at the plaintiff’s
costs. Thereupon the plaintiff by his attorney moves the Court for
Costs. To withdraw the instrument said on and to him leave is given.
Order that Court adjourn until Court in Council.
