Know all men by these presents that I James Hinkle of the County of St. Clair and State of Missouri for and in consideration of The Sum of Four Hundred Dollars to me in hand paid by the County Court of St. Clair aforesaid the receipt whereof is hereby acknowledged, I grant bargain and sell to the County of St. Clair and by these presents do grant bargain and sell to the County of St. Clair for the use of the Common School fund of Said County the following described real Estate That is to say, Lots 2 and 3, North west, Section Seven Township Thirty Eight, Range twenty four Containing 14 17/100 acres More or less Together with all and singular the privileges to have and to hold the above described real estate to the County of St. Clair for the use aforesaid forever upon the Condition nonetheless that whereas the Said James Hinkle did on the 10th day of March 1865 execute his bond for the use of Common School fund and with S.M. Cole and Y.W. Penn as his securities which bond is for the Sum of Four hundred Dollars and is in the names and figures following to wit:
$400.00
Twelve months after date aforesaid named, James Hinkle as principal and P.H. Cole & G.B. Pace as Sureties Jointly and severally jointly to pay to the County of St. Clair for the use of Common School fund the Sum of Four hundred Dollars in full in the lands of the County of St. Clair [ can’t read – too faint]

Now if the said James C. Hinkle Shall owe and duly pay to the County of St. Clair the said fee and deliver of the bond herein & debts where they shall respectively Commence due and payable the amount owed [can’t read] in case of default be made on the payment of the principal or interest, or any part thereof at the time when they [can’t read] of the bond herein the Sheriff of the County of St. Clair May [can’t read] mortgage premises or any part thereof to satisfy the principal and interest upon said cause and make an absolute Conveyance thereof in fact to the purchaser which shall be as effective to all interests and purposes as if such sale and conveyance were made by nature of a Judgment and [can’t read] of complaint Jurisdiction for offering this mortgage.

Be it remembered that on this day of March AD 1865 before the undersigned Clerk of the Circuit Court of the County and State aforesaid personally appeared James C. Hinkle who is personally Known to the undersigned to be the person whose name is subscribed to this instrument of writing as being executor the same and acknowledged the same to be his act and deed herein and sold for the uses and purposes therein Contained.

This day Delia Bunch the widow wife of David A. Bunch herein Comes before Me and Makes herein her intention in her Dowery as taking a childs Part as her part of the Estate of the dec’d David A. Bunch dec’d.
