In Vacation October 28th 1854

Nancy A. Caps vs Andrew J. Caps
Petition for Divorce
Now at this day comes the said plaintiff and files here petition verified by her affidavit And it appearing from said petition and affidavit that the Said defendant is a nonresident of this State It is therefore on application of said plaintiff by her attorney ordered that said defendant be notified by publication of this order that said plaintiff has instituted an action against Said defendant in the Circuit court of St. Clair in the State of Missouri the object and general nature which is to obtain a Divorce from the bonds of Matrimony by her contracted with the Said defendant upon the grounds of cruel and barbarious treatment and Such indignities offered to her person as to render her condition in life intolerable and for Wilful desertion. And that unless he be and appear before the Judge of our Said court at the next April Term thereof to be begun and held at the courthouse in the Town of Osceola on then fifth Monday after the fourth Monday in March next And on or before the third day thereof answer the Said plaintiffs petition the Same will be taken as confessed.
