Petition for Partition of Real Estate
Now at this day comes the petitioners by Waldo P. Johnson their attorney before me James W. Beck clerk of the St. Clair Circuit Court in vacation of said court and it appearing to the said clerk that the defendants Daniel Waldo, Joseph Waldo, Jedediah Waldo, Jacob Morgan and Elizabeth Morgan, William Johnson and Olive Johnson and the children of Isaac Waldo dec’d (whose names are unknown) are nonresidents of the State of Missouri. It is therefore ordered by the said clerk in vacation that the said nonresidents defendants be notified that the said petitioners have this day filed their petition in the office of the clerk of St. Clair circuit court the object of which petition is to obtain partition and division of the following described lands belonging to the Estate of John B. Waldo dec’d To wit: The NE qr of NW qr of Section 3 and E half Lot No. 6 NW fr’l qr of Section 4 and lot no. 6 NW fr’l qr Section 3 and lot No. 2 NW fr’l qr of Section 5 and W half SW qr of Section 5 and SW fr’l qr (NOR) of Section 3 and lot No. 5 NW fr’l qr of Section 4 and lot No. 5 NE fr’l qr of Section 4 and lots No. 6 and 7 NE fr’l qr of Section 4 all in Town 39 of Range 24 West and also S half SW fr’l qr (NOR) of Section No. 10 in Township No. 38 of Range 25 west The whole containing 744 and 88/100 acres all situated in the county of St. Clair and State of Missouri Also if Said land cannot be divided without great prejudice to the owners that the said nonresident defendants be notified that Said plaintiffs will present their petition to The St. Clair circuit court on the first day of next Term thereof or as soon Thereafter as a hearing can be had which term will be begun and held at the court house in the Town of Osceola St. Clair county Mo. on Monday the 28th day of October next and unless They appear and answer said petition Judgment will be rendered by default against them.
